Why Can't I Question the "Social Contract"?




Let’s not mince our words; the “Social Contract” as laid out in the Malaysian Federal Constitution is official racism of the most absurd and blatant of its kind. The “Social Contract” as it was first established under Article 153 of the Federal Constitution grant the Malays special rights and privileges irrespective of even if they are millionaires, just as long as your skin is of a certain colour.

The “Social Contract” originated during independence when the “pendatang” or foreigners (mainly Chinese and Indians) were given the special privilege of citizenship in exchange for the Malays being given “special privileges” as the indigenous people of Malaya. The special privileges include “Malay” entitlement in the areas of business and economy, quotas for certain trade licences, education and public scholarships, quotas into public universities, civil service and politics. Then in 1969, when the ruling UMNO party lost it’s parliamentary majority after the elections and hundreds of Malays ran amok and went on a killing spree at the expense of the Chinese, the New Economic Policy (NEP) was establish to further extend the “Social Contract” which was meant to be only temporary and was recommended to be reviewed after the first fifteen years as advised by the “Reid Commission” which prepared the framework for the Constitution. It was due for review in 1972 but after the May 1969 riots and with a state of emergency declared, it passed without incident.

That’s a bit of history and now the hard questions. I know that the “Social Contract” is not meant to be questioned or challenged but what the hell.

1. Would it not be better for the government to improve funding and cut out corruption in the education sector and improve the overall quality of the education in Malaysia than to reserve certain quotas for Malays irrespective if they’ve earned their place in the institutions of higher learning or not? Would placing quotas based on your skin colour only alienate the other races who will have to work harder, earn more money and fund their own education overseas and after they’re done to never return to Malaysia, choosing to stay on in the country that gave them their higher education as staying on and working there would earn them ten times more than if they returned to their corrupt and racist mother land? The local graduates on the other hand, when they “graduate” are left wanting and can hardly cope with the rigours that face them in the real world. Employers on the other hand are weary of local graduates especially those that made it based on their skin colour.

2. Would it not be better to develop social welfare policies that helped the genuine poor irrespective of their skin colour, that is, help the poor rather than help based on your skin colour? If you are Malay, and are very well off why should you be helped over a poor person just because of your skin colour? No proponent of the “social contract” has given a satisfactory answer to this question to date. Undoubtedly the NEP was designed to help the cronies in the ruling UMNO party rather than to genuinely help any poor person Malay or otherwise.

3. Would it not be better to lift the uncompetitive protection given to the national carmaker “Proton” after so many years, so they can compete on their own two feet? Get the best brains, best training and best quality process in place to make it a national car that the whole country can be proud of instead of the butt of all the jokes even if this means hiring more of people of other races? Why not give the majority of Malaysian citizens the choice to choose other cars of higher quality without imposing such heavy duties to protect Proton? Why would you protect one company at the expense of the other millions of Malaysians? Why do Malaysians have to suffer driving a substandard car at over inflated prices to protect Proton and its cronies?

4. How do you justify an across the board discount for property purchase for Malays when some of these people could be very wealthy? Where is the equity and fairness when a Malay millionaire could purchase a property cheaper than a poor non-Malay because of this institutionalised racism that exist?

5. Would it not be more appropriate if the government could improve skills training to those that needed it most instead of imposing law that requires local companies to meet the hiring quota for Malay people? Many of these companies hire the Malays just to “comply” but the driving force of the companies is the other races. Would that then improve the skills of these “dead wood” that would otherwise just remain dead wood?

6. If there is some law in the constitution agreed or otherwise fifty years ago and if we knew it to be bull shit, could we not question it and amend it if it would be better for the country to do so? All the indicators and also common sense tells us that the social contract is one of the most regressive, absurd and utterly racist policies that exist for Malaysia and it’s hurting the reputation, business environment, competitiveness, quality of life, education and almost every aspect of life as we know it in Malaysia and the only people who don’t want to amend it are the UMNO politicians and their cronies that are benefitting inequitably from the policy. They rape, pilfer and rob the nation with the help of the “social contract” and are enriched so unimaginably and will go to any lengths to ensure it remains that way, even threatening riots and death to anyone who questions the social contract.

The social contract is not working to its initial goal and everyone knows it, even UMNO but its initial goal is no longer a goal worth fighting for and there is a new goal to enrich UMNO and its cronies beyond anyone’s wildest imagination and in order for this new goal to be achieved with vigour, this “social contract” need to remain in place. Anyone questioning the social contract needs to be put in their place either by using a host of draconian laws like the ISA, Sedition Act, Communication and Multimedia Act, Printing Act etc. to be muzzled forever. Malaysia Boleh!

But one thing that you must remember, using your logic and argument, others should have equally the same right to question your citizenship given out to hundreds of thousands new Malayan residents. Please have some respect lah. Is it so hard to give and take, understand and accept what our forefathers had fought for?

  4. ... due to our ignorant we are all blasted into this illussionary world created by our actions , moving in a cycle , we played many roles , thinking this is real we acquired many knowledge about this illussionary world ( the outer science) and never close to the creator of this magical world. The magical world is necessary as its the only way this potent enegry(within us) have the oppurtunity to recognise itself... so any social contract is an illussion of no origin .......... so why worry?...

  11. Should I care about the social contract when the world outside Malaysia is so much bigger. The people who benefited are the Umnoputeras, some ordinary Malays will benefit a little and the rest of ignorant Malays are given crumbs for their continued support to keep UMNO in power.

    Long live the social contract - a sure way to destroy Malay's competitiveness.

    If only UMNO really care for Malaysia, they would realize the tremendous loss of human capital that is keeping Malaysia a 3rd world country despite having 1st world infrastructure.

    Oh well, why should I care - I already have an exit route - thank you Malaysia.

  12. What is the racial breakdown of the amount that the government is paying out every month in terms of salaries and contracts? shouldn't this be considered as well in the calculation of wealth distribution? isn't cash part of wealth?

Social Contract ,,, why the fuss now ....... it been for the 50 odd years already ....... most developers are Chinese ........... most contractors are chinese ............. road developers are Indians .........   21. Hey, I'm a Malay. From one of those Malay kampungs. After 50 years of independent and with the airtight Malay special rights, the Malays and the Malays in the kampungs remain poor and under develop. Only the Malay elite in UMNO have these rights and holding tight to the so called Social Contract. The will never let it go.

    If Americans don't hate the malays, why is there so much bad press against Mahathir when he scolded the Americans? You malays are brainless and never read the newspaper. Everyday special rights here and there……….still like your tongkat so much!

    You go to American embassy and see which country now is blacklisted? Did they blacklist Taiwan, Singapore, Hong Kong?

    Even the Japanese look down upon the malays because they are just a bunch of fool, corrupt, lazy person who feed on the Chinese income tax for their existence.

    The malays want to produce as many pig babies as they want, but doesn’t teach them what is honesty, hardworking, civilisation!

    Worst, what many term as 'malays today' are not actually the original malays of ancient times but 'adopted malays' from other ethnicities such as the Acehnese, Bugis, Minangkabaus and Tamil Muslims.

  27. Konek you comments does not apply to everyone, i am a malay and i am working in a chinese company. I am not dependent on the government. My take home pay is RM 25,000 per month. I hope Malays should start working in the private sectors rather than opt into government jobs. That will be a starting point for a new malaysia.

    Who says that the peninsular was always called Tanah Melayu? This is a recent British term!

    Tanah Melayu was never the name until the British came and colonized the peninsular.

    Malai means hill in Tamil; as to describe the Titiwangsa range on the said peninsular since the 2nd century by the Gujerati traders who set up their formidable Hindu empire at Lembah Bujang.

  29. The Chinese came to Malaysia more than 1000 years ago, while the Indians came here almost 1030 years ago. Kota Gelanggi and Lembah Bujang are proof of these early settlements.

  43. Yes, you can have all the social contract and quotas written down. BUT what is the use when those given the quotas and privileges just want everything to be dropped down from heaven without a sweat ?.

    That is why the RM 52 billion ringgit invested as bumiputra's portion and as part of the 30% quota in those companies are now reduced to only RM 2 billion. Where has the balance gone ?

    Well, those UMNOputras cronies that were handed those billions of shares to be held in trust have sold it in the open market for their own gain and now the government realised they have only a 19% holding left.

    You can shout you want 60% share of the economy but what is the use when you do not put in your own sweat and tears into making it happen. It is better to have 30% with solid holding than an arbitrary figure and start chasing shadows.

  48. There is no such thing as a social contract as far as I know. Yes, there were some negotiations before an agreement was reached and sealed in 1957. This agreement is called the Malaysian Constitution, i.e the supreme laws of the country. Nobody as far I know is questioning the Malaysian Constitution.

    By blowing hot air, the politicians (on both sides of the divide) are creating a very unhealthy enviroment.

    Maybe we, the rakyat, the tax payers and voters should be discussing the weakness in our Goverment's delivery system especially on, "how our hard earned money is been spent on useless projects with no real returns". We the rakyat, the tax payers and voters are always kept in the dark. We need more transparency in how our Goverment functions especially when it involves
    our money. Once we do this, the politicians (on both side of the divide) will automatically start respecting us the rakyats, the tax payers and voters. Until then we are just minch meat for them.

    MY TEARS ROLLED DOWN UPON READING THIS POINT AS IT SOUNDS SO PERTINENT TO ME. I WENT TO A LAUNCHING OF A NEW HOUSING SCHEME TODAY, AND IT WAS FULL OF RICH MALAYS -- RICH INFERRED FROM THE CARS THEY DRIVE AND THEIR OCCUPATIONS. WHILE THESE RICH MALAYS COULD PURCHASE THE HOMES AT REASONABLE PRICES, I HAVE TO PAY A MUCH HIGHER PRICE BECAUSE OF THE COLOUR OF MY SKIN (OR SHOULD I SAY MY RELIGION -- BECAUSE SOME INDIAN MUSLIMS TOO MANAGED TO GET SUCH PRIVILEGED PRICE). I THINK SUCH TWO-TIER HOUSE PRICING IS NOT IN THE CONSTITUTION BUT THE MALAYS TWISTED (OR INTERPRETED LIKE HOW THEY OFTEN INTERPRETED THE ORIGINAL HOLY QURAN) JUST TO FIT THEIR AGENDA.     This piece of information is NOT complete. Do you know that there is a double standard in pre-university qualification? Most non-Malays have to do a rigorous 2-year STPM (A-level equivalent) as compared to most Malays who will be sent to residential colleges to do a one-year watered-down sub-standard matriculation. But then, when gaining entrance to the university, the results of STPM and matriculation are comparable -- just like placing equal educational value for 1 kg of gold and 1 kg of stone! On one hand, government is advocating for same syllabuses throughout right from Year 1 irrespective of schools or race, but how come the syllabuses for pre-university education is different? Social contract?
